Welcome to Shotly, operated by Moka IT Engineering Kft ("Company," "we," "our," or "us").

These Terms of Use ("Terms") govern your use of the Shotly mobile application ("App").

By downloading or using Shotly, you agree to these Terms. If you do not agree, please do not use the App.

Eligibility

  • You must be 4 years or older to use Shotly.
  • If you use the Service on behalf of an organization, you confirm you have authority to bind it.
  • By using Shotly, you represent that you meet these eligibility requirements.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Shotly for personal, non-commercial purposes, subject to these Terms.

You may not:

  • Sell, rent, sublicense, distribute, or commercially exploit the App.
  • Reverse-engineer, copy, or modify the App or its code.
  • Remove or alter any copyright, trademark, or proprietary notices in the App.
  • Scrape or attempt to extract source code or data.
  • Interfere with, disrupt, or overload our infrastructure.

Accounts

  • Keep your credentials confidential.
  • You are responsible for all activity under your account.
  • One individual per account. No account sharing or creating multiple accounts to bypass limits.

User Content

Shotly allows you to upload and process images. By using this feature, you agree that:

  • You only upload content you own or have rights to use.
  • You are solely responsible for the content you upload.
  • You grant us a limited, revocable license to process your content to provide App features (including essential operations like abuse prevention and billing).

You own the headshots and images you generate.

We do not claim ownership over your uploaded content.

We do not use your uploads or outputs to train AI models.

You may delete your images and account data at any time. See our Privacy Policy for how to delete your media. Note that our image processor Fal.AI retains processing artifacts for up to 10 days before they are deleted on their systems.

Acceptable Use

You agree not to:

  • Upload or generate content involving minors (under 18) in any inappropriate manner.
  • Create or share pornographic, sexual, or explicit content.
  • Impersonate any person without their explicit written consent.
  • Create or share content that is defamatory, hateful, discriminatory, violent, threatening, fraudulent, or deceptive.
  • Violate privacy, intellectual property, or other legal rights.
  • Use Shotly for unlawful, harmful, or offensive purposes.
  • Upload or generate content that is illegal or infringes on others' rights.
  • Attempt to interfere with the operation or security of the App.
  • Violate any applicable law.

We may remove content or suspend accounts that violate these Terms.

Third-Party Services

Shotly integrates with third-party services to process and generate AI images and provide other functionality. These may include, but are not limited to:

  • Fal.AI - AI image processing and generation
  • Superwall - Subscription and payment management
  • Supabase - Backend infrastructure and data storage
  • Stripe - Payment processing
  • Apple In-App Purchases - Payment processing

By using Shotly, you agree that these third-party services may process your uploaded content as required to provide the App's features. Their terms and privacy practices apply to their services.

Payments & Subscriptions

Shotly offers in-app purchases through the Apple App Store.

  • Payments are processed by Apple. Prices are shown before purchase.
  • No refunds once digital processing begins.
  • Subscriptions auto-renew unless cancelled before renewal.
  • Cancel anytime in your account or by emailing danielmoka@mokaie.com. Access continues until the end of the paid period.
  • All payments are handled by Apple under their terms and conditions. We do not store your payment details.

Intellectual Property

All rights, title, and interest in Shotly (excluding user content) remain the property of Moka IT Engineering Kft or its licensors.

Service Changes & Availability

  • We may add, change, or remove features, or suspend the Service for maintenance or other reasons.
  • We may update these Terms; material changes will be notified via the App or email.
  • We do not guarantee uninterrupted or error-free service.

Disclaimers

The Service is provided "as is" and "as available."

To the extent permitted by law, we disclaim all warranties, including but not limited to:

  • Merchantability, fitness for a particular purpose, and non-infringement.
  • Uninterrupted, error-free, or secure operation.
  • Accuracy or reliability of content or results.

Shotly is provided without warranties of any kind. To the fullest extent permitted by law, Moka IT Engineering Kft is not liable for any damages arising from your use of the App, including data loss, device issues, or misuse of generated content.

Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill arising from your use of the App.
  • Our aggregate liability is limited to the fees you paid in the 12 months before the claim (or €100 if no fees were paid).

Local mandatory consumer rights remain unaffected.

Termination

We may suspend or terminate your access to Shotly if you violate these Terms or for legal requirements.

You may stop using Shotly at any time by deleting the App from your device.

Upon termination, your right to use the Service ends. Sections that should survive termination (including Intellectual Property, Limitation of Liability, and Governing Law) will continue to apply.

Governing Law & Venue

These Terms are governed by the laws of Hungary and applicable EU law, without regard to conflict of law principles.

Courts in Hungary have exclusive jurisdiction for any disputes arising from these Terms.

Changes to Terms

We may update these Terms from time to time. Any changes will be posted in the App and/or on our website with a new "Last updated" date.

For material changes, we will provide additional notice (e.g., email or in-app notification).

Continued use of Shotly after changes means you accept the updated Terms.
